Cancellation policy for users

A user, so a natural person, who concludes a legal transaction for a purpose which cannot be attributed to their commercial or independent professional activity, is entitled to the following right of cancellation in the case of a distance selling contract, i.e. a contract which comes into force without the contract partners being physically present at the same time using means of telecommunication (e.g. e-mail, internet, telephone, fax, mail):

You can revoke your contractual statements within 14 days without stating reasons in text form (e.g. letter, fax, e-mail) or – if the thing has been conveyed to you before the expiry of the period, also cancel by returning the thing. The period begins after receipt of this policy in text form, but not before receipt of the goods by the recipient (in the case of a recurring delivery of the same kind of goods, not before receipt of the first part delivery) and also not before the fulfilment of our obligations to provide information in accordance with Article 246 § 2 in connection with § 1 paras. 1 and 2 EGBGB [Introductory Code to the German Civil Code], as well as our obligations according to § 312g para. 1 sentence 1 BGB [German Civil Code] in connection with Article 246 § 3 EGBGB. In order to observe the cancellation period it is enough to timeously send the cancellation or the thing. The cancellation is to be made to:

Consequences of cancellation
If a cancellation is effective, the services received on both sides are to be reimbursed and, where applicable, uses drawn (e.g. interest) are to be returned. If you cannot reimburse or return the service as well as uses (e.g. advantages of use) or can only partly reimburse or return it or can only return it in worse condition to Grammer Solar GmbH, you must compensate Grammer Solar GmbH in this respect for the value. You must only compensate the value for deterioration of the thing insofar as the deterioration is attributable to a handling of the thing which goes beyond checking the quality and functionality. “Checking the quality and functionality” is understood as tests and trying out the particular goods, as would be possible and common in a retail outlet. Things which can be shipped in a package are to be returned at the risk of Grammer Solar GmbH. You are to carry the costs of return if the delivered goods correspond with the what was ordered and if the price of the thing to be returned does not exceed 40 euros or, if the thing has a higher price, you have not yet performed the counter-performance or made a contractually agreed part payment at the time of the cancellation. Otherwise the return is free of charge for you. Things which cannot be shipped by package will be collected from you. Obligations to make payments must be fulfilled within 30 days. The period begins for you with the sending of your cancellation or the thing; it begins for Grammer Solar GmbH with its receipt.
There is no right of cancellation for distance sales contracts:

• for the delivery of goods which shall be made according to customer specifications or
• which are clearly tailored for personal needs or
• which are not suitable for return on the basis of their properties or
• which can quickly spoil or
• if its expiry date was exceeded
